IMPORTANT: Read This Before Using Our Services. By accessing this website, inputting a token contract address, or purchasing any custom product, you acknowledge that you have read, understood, and agreed to these entire Terms of Service and all incorporated policies. These terms form a legally binding agreement between you and the operator of MemeMoon. If you do not agree to all terms, you must not use or access our Services.

OVERVIEW

Welcome to MemeMoon. The terms “we”, “us”, and “our” refer to MemeMoon. MemeMoon operates this store and website, including all related information, content, features, tools, products, and services (the “Services”), in order to provide you, the customer, with a curated reality merch shopping experience. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of any account credentials and for all activity occurring under your interaction with the site. You represent and warrant that all information you provide is correct, current, and complete.

SECTION 2 - SPECIFIC TERMS FOR TOKEN DESIGNS & FAN ART

Our Services utilize an automated process where you, the user, input a third-party token contract address (“Token”). Our system retrieves public third-party information (“Token Information”) to generate a design.

  • User-Initiated Process: The generation of a design is a direct and automated response to the contract address you input, initiated solely by you. MemeMoon acts merely as a neutral automated platform and technical service provider.

  • Fan Art Nature: Any design containing Token Information is deemed a “Fan Art” creation. It is a personal expression and DO NOT represent an official, licensed product of any Token project or Project Party.

  • No Official Affiliation: MemeMoon is not affiliated, associated, authorized, or endorsed by any Project Party.

  • Third-Party IP: Token Information may include trademarks or copyrights owned by third parties. MemeMoon does not own or license this IP. You assume all responsibility for the use of the Token address you provide.

SECTION 3 - OUR PRODUCTS & AESTHETIC ACKNOWLEDGMENT

We strive for accuracy, but colors and appearance may differ based on your screen settings and device configuration.

  • Aesthetic Limitations: All Token Information will be modified into our non-official Fan Art aesthetic (e.g., Pixel Art, Gray Dotted patterns, "FAN ART" suffix). You acknowledge this mandatory stylistic rendering is a core feature of our Service and cannot be modified or reversed.

  • Variation: We do not warrant that the final product will meet your subjective expectations or be identical to digital renders.

SECTION 4 - ORDERS AND STRICT AFTER-SALES POLICY

MemeMoon reserves the right to accept or decline your order for any reason at its discretion.

  • Strict No-Refund Policy: Because our products are user-initiated and custom-made (Print-on-Demand), all sales are FINAL. We do not accept returns or refunds for subjective reasons, including but not limited to: "change of mind," "color/style deviation," or "dislike of the pixelated effect."

  • Damage Claims & Mandatory Unboxing Video: Refunds or replacements are ONLY granted for verifiable physical manufacturing defects or severe shipping damage. To qualify, you MUST provide a continuous, unedited video of the unboxing process, starting from the original sealed state of the courier packaging. Failure to provide this video, or providing a video that shows signs of tampering, will result in immediate rejection of your claim.

  • Final Authority: MemeMoon reserves the absolute and final right to handle and adjudicate all order disputes.

SECTION 5 - PRICES, BILLING & CUSTOMS

Prices are subject to change without notice.

  • Taxes & Duties: Posted prices do not include taxes, shipping, or handling. For international orders, you are responsible for all import duties, customs fees, and local taxes. If a package is returned due to your refusal to pay customs fees, no refund will be issued.

  • Payment: You represent that you are authorized to use the payment method provided and that all charges will be honored.

SECTION 6 - SHIPPING AND DELIVERY

We are not liable for delays caused by carriers, global logistics disruptions, or customs processing. Once products are transferred to the carrier, title and risk of loss pass to you. Delivery times are estimates only.

SECTION 7 - INTELLECTUAL PROPERTY & TAKEDOWN POLICY (DMCA)

MemeMoon owns all Service materials (including trademarks, website code, and original graphics), excluding user-initiated Token Information.

  • Takedown Policy: If you are a rights owner and believe a design generated via our automated tool infringes your rights, please contact mememoon.store@gmail.com. Upon valid notice, we will act expeditiously to remove or disable access to the infringing design.

SECTION 8 - THIRD-PARTY TOOLS & DATA ACCURACY

Provision of Tools: Access to third-party tools (including systems for on-chain data retrieval) is provided on an “as is” and “as available” basis without any warranties.

  • Data Accuracy & Liability: We do not monitor, endorse, or control information sourced from external public networks. MemeMoon shall not be liable for any errors, inaccuracies, omissions, or the lack of availability in Token Information retrieved from third-party sources. Any reliance on such data is strictly at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

MemeMoon is powered by Shopify Inc. You acknowledge and agree that Shopify is a third-party platform provider and is not responsible for the products, content, or sales transactions of MemeMoon. You hereby release Shopify from any claims or liabilities arising from your purchases or use of our Services.

SECTION 10 - PRIVACY POLICY & FEEDBACK

  • Privacy: Your submission of personal information through the store is governed by our Privacy Policy and Shopify’s Privacy Policy.

  • Feedback: You grant us a perpetual, worldwide license to use any feedback or reviews you submit in any medium for any purpose.

SECTION 11 - PROHIBITED USES

You may use the Services for lawful purposes only. You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon or violate our intellectual property rights or those of others; (c) to submit false or misleading information; or (d) to upload viruses or malicious code.

SECTION 12 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The Services and all products are provided 'as is' without any warranties of any kind, express or implied. In no case shall MemeMoon, our directors, or affiliates be liable for any injury, loss, or claim—including those relating to trademark infringement or copyright infringement—arising from your use of user-generated designs or products.

SECTION 13 - INDEMNIFICATION

You agree to indemnify and hold harmless MemeMoon and its affiliates from any claims, damages, or legal fees arising out of your breach of these Terms, your violation of any law, or your use of the Services to generate third-party content.

SECTION 14 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the MemeMoon Service operator is headquartered, without regard to its conflict of law provisions.
